Terms of Service

1. Who we are
Berraca ("Berraca", "we", "us") operates an online platform that lets women in the Netherlands list services and arrange skill-for-skill swaps or credit-based exchanges with each other. These Terms form a binding agreement between you and Berraca when you create an account or use the platform.
2. Who can use Berraca
You must be at least 18 years old, identify as a woman, and have legal capacity to enter into contracts under Dutch law. You are responsible for keeping your account credentials confidential and for all activity that happens under your account.
3. Berraca is a platform, not a party
Every swap or credit-based exchange is a direct agreement between the two members involved. Berraca introduces members, records the agreed terms (services, fair value, date), and tracks completion confirmations. We are not a party to that agreement, do not employ or supervise members, and do not guarantee, insure, or warrant the quality, timeliness, safety, or outcome of any service exchanged on the platform.
4. Independent status — no employment
You acknowledge that you act on Berraca as an independent person, not as an employee, agent, partner, or contractor of Berraca. Nothing in these Terms creates an employment, agency, joint venture, or partnership relationship between you and Berraca. We do not direct, schedule, price, or supervise the work you perform. You are solely responsible for how you deliver any service, including compliance with the rules that govern self-employment in the Netherlands and avoidance of schijnzelfstandigheid(false self-employment) situations with members or third parties.
5. Tax responsibility
You are solely responsible for your own tax compliance. Berraca does not collect, withhold, declare, or remit any tax on your behalf.
Under Dutch tax law, bartered professional services (skill-for-skill swaps) and credit-based exchanges may be treated as taxable income at the fair market value of the service you receive, and may also be relevant for VAT (BTW) obligations if you are registered as a self-employed person (zzp'er) or otherwise carry on an economic activity. The classification of your activity as a hobby or a business is determined by the Belastingdienst based on the facts of your situation — not by Berraca.
Each completed swap on Berraca generates a transaction receipt with the service description, the agreed fair value in euros, the date, and the parties involved. We provide this so you can document exchanges in your own tax records. The receipt is not a VAT invoice. If you are required to issue a VAT invoice to your swap partner, you must do so separately, outside the platform.
We strongly recommend you consult a Dutch tax advisor about how barter income and credit-based exchanges should be reported in your inkomstenbelasting and BTW returns.
6. Platform reporting (DAC7)
Berraca is a digital platform that facilitates the provision of personal services and is therefore subject to the EU directive on administrative cooperation in the field of taxation (DAC7), as implemented in the Netherlands. Once we reach the reporting thresholds set by the directive, we may be required to collect identifying information from members (such as full name, address, date of birth, and tax identification number / BSN), record the value of swaps you complete on the platform, and report this information annually to the Belastingdienst, which may share it with the tax authority of your country of residence.
By using Berraca, you agree to provide accurate information when we ask for it and acknowledge that we may be legally required to report your activity even if you personally classify it as non-commercial.
7. Personal favors vs. professional services
When proposing a swap, members may flag the exchange as a personal favor — a casual, non-commercial exchange between acquaintances rather than the provision of a professional service. This flag is informational only and does not change anyone's tax obligations. The Belastingdienst makes the final determination of whether an activity is commercial or non-commercial.
8. Fees
Listing services and browsing Berraca are free. A platform fee of €5 applies to each accepted swap, charged to the requester. Credits ("1 credit = €1") are an internal unit used to settle credit-based exchanges and top-ups; they have no cash value outside the platform and are not refundable in euros.
9. Acceptable use
You will follow the Community Guidelines, treat other members with respect, deliver swaps in the quality and timeframe you agree to, and not use Berraca for fraud, harassment, impersonation, MLM recruiting, or any activity that is unlawful in the Netherlands. Repeated cancellations, no-shows, or guideline violations can result in suspension or permanent removal.
10. Verification and ID checks
To unlock the Verified badge you may submit a government-issued ID and a selfie. These documents are reviewed by a Berraca admin, stored privately, and never shared with other members. Submitting forged or borrowed documents is grounds for permanent removal and may be reported to the relevant authorities.
11. Limitation of liability
To the maximum extent permitted by Dutch law, Berraca is not liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with a swap, including damage to property, personal injury, loss of income, missed deadlines, dissatisfaction with service quality, or tax assessments issued against you. The platform is provided "as is" without warranties of any kind. You agree that any dispute about the service exchanged is between you and your swap partner.
Nothing in these Terms limits liability that cannot be excluded under Dutch consumer-protection law.
12. Privacy
We process your personal data in accordance with the GDPR and Dutch privacy law. Profile information you choose to make public is visible to other members; ID verification documents and tax-identifying information are not. We do not sell your personal data.
13. Termination
You may close your account at any time. We may suspend or terminate accounts that violate these Terms, the Community Guidelines, or applicable law. Outstanding credit balances at termination expire and have no cash value.
14. Changes
We may update these Terms as the platform evolves. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of Berraca after the effective date constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the Netherlands. Disputes that cannot be resolved between you and Berraca will be brought before the competent court in Amsterdam, without prejudice to your mandatory consumer rights to bring proceedings in the court of your domicile.
